Alora Crew respects the privacy of Candidates, Employers, website visitors and other persons who use our services.
This Privacy & POPIA Policy explains how Alora Crew collects, uses, stores, shares, protects and otherwise processes personal information.
Alora Crew is operated by Tertius Niell Le Roux, trading as Alora Crew, in South Africa.
For purposes of applicable data-protection legislation, Alora Crew may act as the responsible party in relation to personal information processed through the Platform.
Alora Crew operates an international yacht and superyacht recruitment platform connecting Candidates with yacht owners, captains, management companies and other legitimate Employers.
By using Alora Crew, you acknowledge the processing practices described in this Policy, subject to any consent or other lawful basis required by applicable law.
2. APPLICABLE DATA-PROTECTION LAW
Alora Crew processes personal information in accordance with applicable law, including the Protection of Personal Information Act 4 of 2013 (āPOPIAā).
Where Candidates or Employers are located outside South Africa, additional data-protection requirements may apply.
Alora Crew will take reasonable steps to comply with applicable privacy and data-protection requirements relevant to its processing activities.
3. WHO THIS POLICY APPLIES TO
This Policy applies to personal information relating to:
Candidates;
Employers;
VIP Employers;
yacht owners;
captains;
yacht-management representatives;
recruiters;
website visitors;
persons communicating with Alora Crew;
references provided by Candidates; and
other persons whose information is lawfully processed through the Platform.
4. INFORMATION WE MAY COLLECT
The information collected depends on how you use Alora Crew.
Candidate Information
Candidates may provide information including:
first name;
surname;
date of birth;
gender;
nationality;
current location;
telephone and mobile number;
email address;
profile photograph;
employment history;
yacht experience;
previous vessel information;
position and role experience;
education;
professional qualifications;
maritime qualifications;
STCW certificates;
certificates of competency;
medical certificates;
visas and work authorisations;
languages;
skills;
availability;
preferred positions;
salary expectations or preferences where requested;
references;
CV or rƩsumƩ;
supporting certificates;
uploaded documents;
Candidate profile information; and
other information voluntarily supplied for recruitment purposes.
Where reasonably required for recruitment, identity, eligibility or document verification, Alora Crew may process additional information contained in documents supplied by the Candidate.
Candidates should avoid supplying personal information that is unnecessary for recruitment.
5. EMPLOYER INFORMATION
When an Employer registers or uses Alora Crew, we may collect:
name;
surname;
email address;
telephone number;
job title;
yacht or vessel name;
vessel information;
company or management-company information;
billing information;
recruitment requirements;
vacancy information;
account information;
communications with Alora Crew;
subscription information;
transaction records; and
other information reasonably necessary to provide Employer services.
6. PAYMENT INFORMATION
VIP Employer membership payments may be processed using WooCommerce together with an authorised payment gateway or payment-service provider.
Alora Crew may receive information relating to:
payment status;
transaction reference;
amount;
currency;
billing information;
subscription status;
renewal dates;
failed payments; and
cancellation status.
Complete debit or credit-card details may be processed directly by the relevant payment provider rather than stored by Alora Crew.
Payment providers process information according to their own security standards, privacy notices and legal obligations.
7. TECHNICAL AND WEBSITE INFORMATION
When you visit Alora Crew, certain technical information may be collected automatically, including:
IP address;
browser type;
device type;
operating system;
pages visited;
login activity;
referring pages;
approximate location derived from technical information where applicable;

creating Candidate Profiles;
enabling Candidates to apply for vacancies;
allowing authorised Employers to search for Candidates;
matching Candidates with vacancies;
assessing Candidate suitability;
conducting Candidate interviews;
verifying information;
checking references;
checking qualifications and documents;
facilitating recruitment;
communicating with Candidates and Employers;
sending application notifications;
sending matching notifications;
operating VIP Employer services;
processing subscriptions and payments;
preventing fraud;
maintaining Platform security;
responding to support requests;
improving Alora Crew;
administering accounts;
maintaining appropriate business records;
complying with legal obligations; and
establishing, exercising or defending legal rights.
Alora Crew will not intentionally process personal information for purposes incompatible with the purpose for which it was collected unless permitted by law.
9. CANDIDATE PROFILES AND EMPLOYER ACCESS
The purpose of a Candidate Profile is to assist the Candidate in obtaining employment within the yacht and superyacht industry.
Candidates therefore acknowledge that certain profile information may be made available to authorised Employers using Alora Crew.
Depending on Platform functionality and access permissions, Employers may be able to view information including:
Candidate name;
profile photograph;
professional summary;
experience;
qualifications;
skills;
availability;
nationality;
current location;
employment history;
uploaded CV; and
other recruitment-related information.
Access to particularly sensitive documents or information may be restricted or provided only where reasonably necessary.
Employers are permitted to use Candidate information solely for legitimate recruitment and employment purposes.
Employers must not:
sell Candidate information;
publish Candidate information publicly;
use Candidate information for unrelated marketing;
create unrelated commercial databases using Candidate information;
share Candidate information unnecessarily;
scrape Candidate profiles;
misuse Candidate documents; or
process Candidate information unlawfully.
Employer access may be suspended or terminated where Candidate information is misused.
10. CANDIDATE MATCHING
Alora Crew may use automated and/or semi-automated technology to compare Candidate information with vacancy requirements.
Matching may consider information such as:
role;
experience;
qualifications;
certificates;
vessel experience;
skills;
location;
availability;
visa or work requirements;
nationality where lawfully relevant;
gender preference where lawfully permissible; and
other Employer requirements.
Matching results are intended to assist recruitment and do not guarantee employment or Candidate suitability.
Important recruitment decisions should not be based solely on an automated match percentage.
Employers remain responsible for assessing Candidates and making final recruitment decisions.
11. INTERVIEWS, REFERENCES AND VERIFICATION
Alora Crew may process Candidate information when conducting:
interviews;
reference checks;
employment-history verification;
certificate verification;
qualification checks;
document verification; and
other reasonable recruitment screening.
Where a Candidate provides another person’s details as a reference, the Candidate should ensure that they are entitled to provide those details for reference-checking purposes.
Information obtained through screening will only be processed for legitimate recruitment, verification, security or related purposes.
12. HOW WE OBTAIN PERSONAL INFORMATION
Information may be obtained:
directly from Candidates;
directly from Employers;
through account registration;
through Candidate profiles;
through job applications;
through uploaded documents;
through correspondence;
through interviews;
from references;
through payment providers;
through website technology;
from publicly available professional sources where lawful and appropriate; and
from other lawful sources relevant to recruitment.
13. LAWFUL PROCESSING
Alora Crew will process personal information only where there is an appropriate lawful basis for doing so.
Depending on the circumstances, processing may be based on:
consent;
performance of a contract;
steps requested before entering into a contract;
compliance with a legal obligation;
protection of a legitimate interest of the person concerned;
legitimate interests pursued by Alora Crew or a third party where permitted by law; or
another lawful basis recognised under applicable legislation.
Where processing specifically requires consent, consent may be withdrawn, subject to applicable law and any other lawful basis on which processing may continue.
14. SPECIAL PERSONAL INFORMATION
Certain documents or information supplied during recruitment may contain information that receives additional protection under applicable law.
Alora Crew will only process special personal information where permitted by law and reasonably necessary for the relevant purpose.
Alora Crew does not require Candidates to provide unnecessary special personal information.
15. SHARING PERSONAL INFORMATION
Alora Crew may share personal information with appropriate recipients where reasonably necessary.
These may include:
authorised Employers;
captains;
yacht owners;
yacht-management companies;
legitimate recruitment representatives;
service providers;
hosting providers;
IT and security providers;
payment processors;
email providers;
messaging providers;
professional advisers;
regulatory authorities;
law-enforcement authorities where legally required; and
other parties where disclosure is permitted or required by law.
Alora Crew does not sell Candidate personal information.
Service providers that process personal information on behalf of Alora Crew are expected to process such information appropriately and securely.
16. INTERNATIONAL RECRUITMENT AND CROSS-BORDER TRANSFERS
Alora Crew operates in the international yacht and superyacht recruitment industry.
Candidates acknowledge that prospective Employers, captains, yacht owners and management companies may be located outside South Africa.
Consequently, Candidate personal information may in appropriate circumstances be accessed from or transferred to another country for legitimate recruitment purposes.
Alora Crew will take reasonable steps to ensure that cross-border transfers of personal information comply with applicable data-protection requirements, including section 72 of POPIA where applicable.
Depending on the circumstances, a transfer may occur where:
the recipient is subject to appropriate data-protection requirements;
appropriate contractual safeguards are in place;
the Candidate consents to the transfer where legally appropriate;
the transfer is necessary for performance of a relevant contract;
the transfer is necessary for implementation of measures requested by the Candidate; or
another lawful basis permits the transfer.
Because international privacy laws vary, privacy protections in another country may differ from those applicable in South Africa.
17. DATA SECURITY
Alora Crew will implement reasonable technical and organisational safeguards appropriate to the nature of the personal information processed.
Measures may include:
access controls;
password protection;
account authentication;
role-based access;
website security;
secure hosting;
software updates;
backups;
malware protection;
restricted administrative access; and
appropriate procedures for handling Candidate documents.
No internet-based system can guarantee absolute security.
Users are also responsible for protecting their account passwords and login credentials.
18. SECURITY INCIDENTS
If Alora Crew becomes aware of a security compromise involving personal information, Alora Crew will investigate the incident and take appropriate steps.
Where required by applicable law, Alora Crew will notify the Information Regulator and affected persons.
Users should contact Alora Crew immediately if they believe their account or personal information has been compromised.
19. RETENTION OF PERSONAL INFORMATION
Alora Crew will retain personal information only for as long as reasonably necessary for the purpose for which it was collected or as required or permitted by law.
Retention periods may depend on:
whether an account remains active;
ongoing recruitment activity;
legal obligations;
contractual obligations;
dispute resolution;
fraud prevention;
security requirements;
accounting and transaction requirements; and
legitimate business record-keeping requirements.
When personal information is no longer reasonably required, Alora Crew will take reasonable steps to delete, destroy, anonymise or restrict the information as appropriate.
20. CANDIDATE ACCOUNT CLOSURE
Candidates may request closure of their Alora Crew account.
Closing an account does not necessarily require immediate deletion of every record where Alora Crew is legally entitled or required to retain particular information.
Where information must be retained, access may be restricted where appropriate.
21. YOUR PRIVACY RIGHTS
Subject to applicable law, a person may have rights to:
ask whether Alora Crew holds personal information about them;
request access to their personal information;
request correction of inaccurate or incomplete information;
request deletion or destruction where legally applicable;
object to certain processing;
withdraw consent where processing relies upon consent;
object to certain direct marketing;
request restriction of processing where applicable; and
lodge a complaint with the Information Regulator or another competent data-protection authority.

Alora Crew may need to verify the identity of the person making a request before releasing, correcting or deleting personal information.
22. CORRECTING CANDIDATE INFORMATION
Candidates are responsible for keeping their Candidate Profiles reasonably accurate and current.
Where Platform functionality permits, Candidates may update information directly through their account.
Alternatively, a Candidate may contact Alora Crew regarding information that cannot be changed directly.
23. MARKETING COMMUNICATIONS
Alora Crew may send marketing or promotional communications where permitted by applicable law.
Where consent is required, marketing will only be sent after the necessary consent has been obtained.
Recipients may withdraw from electronic marketing using the unsubscribe functionality provided or by contacting Alora Crew.
Withdrawal from marketing does not prevent Alora Crew from sending necessary transactional or service communications.
24. SERVICE COMMUNICATIONS
Alora Crew may send communications necessary for operation of the Platform, including:
account notifications;
application confirmations;
Candidate-match notifications;
vacancy notifications;
payment confirmations;
subscription information;
security alerts;
administrative notices; and
important changes affecting a User’s account or service.
These communications are distinct from general marketing.
25. WHATSAPP COMMUNICATIONS
Where a User provides a mobile number and uses or enables functionality involving WhatsApp, Alora Crew may send appropriate recruitment or service-related notifications through WhatsApp.
This may include notifications relating to:
Candidate applications;
Candidate matches;
vacancies;
recruitment activity; and
account-related services.
WhatsApp is a third-party service and its own terms and privacy practices apply when Users interact through that service.
26. COOKIES
Alora Crew uses cookies and similar technologies where necessary to operate, secure and improve the Platform.
Cookies may be used for purposes including:
authentication;
account sessions;
WooCommerce functionality;
security;
preferences;
analytics; and
website performance.
Where legally required, non-essential cookies will be subject to appropriate consent.

27. THIRD-PARTY LINKS AND SERVICES
The Platform may contain links to or integrations with third-party services.
Alora Crew is not responsible for the privacy practices of independent third parties.
Users should review the privacy policies of third-party services before providing personal information to them.
28. CHILDREN
Alora Crew is a professional recruitment platform and is not intended for use by children who are not legally eligible to seek the relevant employment.
Alora Crew does not knowingly seek to collect children’s personal information except where lawful and specifically required.
If Alora Crew becomes aware that children’s personal information has been improperly provided, appropriate action will be taken.
29. EMPLOYER PRIVACY RESPONSIBILITIES
Employers accessing Candidate information through Alora Crew have independent responsibilities regarding the information they receive.
Candidate information must be:
kept secure;
accessed only by appropriate persons;
used only for legitimate recruitment purposes;
retained only as reasonably necessary;
protected from unauthorised disclosure; and
processed in accordance with applicable privacy and employment laws.
Access to Alora Crew does not give an Employer ownership of Candidate personal information.

Alora Crew will maintain an Information Officer arrangement as required under applicable South African data-protection legislation.

31. INFORMATION REGULATOR
Persons who believe that their personal information has been processed contrary to POPIA may have the right to lodge a complaint with the Information Regulator (South Africa).

Users are encouraged to contact Alora Crew first where appropriate so that we have an opportunity to investigate and resolve a privacy concern.
This does not affect a person’s right to approach the Information Regulator.
